Terms of service

Welcome to Donna's Woodworks. These Terms of Service explain the terms that apply when you visit my website, browse my products or place an order with me.

By using my website or placing an order, you agree to these Terms of Service and my Privacy Policy.

Donna's Woodworks is a small UK business selling handmade wooden products and decorations. I currently only accept orders for delivery within the United Kingdom.

1. About My Business

Donna's Woodworks is operated by me as a small business.

Trading name: Donna's Woodworks
Email: donnaswoodworks@outlook.com
Business address: Deer view lodge, 104 Colchester road, St osyth, CO168HB

If you have any questions about an order, my products or these Terms, please contact me using the email address above.

2. Using My Website

You may browse and use my website for lawful purposes and for purchasing products from Donna's Woodworks.

You must not use my website to:

  • break the law;
  • attempt to gain unauthorised access to my website or systems;
  • introduce viruses, malware or other harmful material;
  • copy, reproduce or commercially use my photographs, designs, descriptions, branding or other content without my permission;
  • interfere with the operation or security of my website; or
  • use automated systems to copy or collect content from my website without my permission.

I reserve the right to restrict or terminate access to my website where I reasonably believe these Terms have been breached.

3. My Products

I make every reasonable effort to ensure that product photographs, descriptions, colours, measurements and other information on my website are accurate.

Because many of my products are handmade and made from natural wood, each item may have its own natural variations, including differences in grain, knots, markings, colour and texture. These variations are a natural characteristic of wooden products and are not necessarily defects.

Colours may also appear slightly different depending on your device, screen and settings.

I reserve the right to make reasonable changes to product designs, descriptions or availability. If a product is no longer available, I may remove it from my website.

Nothing in these Terms affects your legal rights as a consumer.

4. Placing an Order

When you place an order through my website, you are making an offer to purchase the products in your basket.

Your order will be confirmed once I have accepted it and your payment has been successfully processed.

I may need to refuse or cancel an order in exceptional circumstances, for example if:

  • a product is unexpectedly unavailable;
  • there has been an obvious pricing or listing error;
  • I am unable to fulfil the order; or
  • I reasonably suspect fraudulent activity.

If I cancel an order after payment has been taken, I will provide a full refund of the amount paid for the cancelled order.

Please check your order carefully before completing your purchase, particularly your delivery address and selected products.

5. Prices and Payment

All prices shown on my website are in pounds sterling (£).

The price you pay will be the price displayed when you place your order, unless there has been an obvious error.

Delivery charges will be shown separately before you complete your purchase.

I reserve the right to change my prices, but any price change will not affect an order that I have already accepted.

Payments are processed through the payment methods made available through my Shopify store.

6. Delivery

I currently only deliver to addresses within the United Kingdom.

Available delivery options and delivery charges will be shown at checkout.

Delivery times are estimates and may vary depending on the delivery service used. I will aim to dispatch orders within the timeframe stated on my website or at checkout.

Once an order has been dispatched, delivery may be affected by circumstances outside my control, such as postal delays, adverse weather, strikes or other disruptions.

I will not be responsible for delays caused by the delivery carrier that are outside my reasonable control. However, this does not affect your legal rights if an item fails to arrive within the legally required timeframe or within an agreed delivery period.

If your order does not arrive within the expected timeframe, please contact me and I will do my best to assist you.

7. Risk and Delivery

For consumer orders, I remain responsible for the goods until they are delivered to you or to a person you have identified to receive them.

If an item arrives damaged, please contact me as soon as reasonably possible and provide photographs of the item and packaging where possible. This will help me investigate the issue with the delivery service and arrange an appropriate solution.

8. Returns and Your Right to Cancel

If you purchase a standard product from my website, you generally have a legal right to cancel your order within 14 days of receiving the goods, without needing to give a reason.

After telling me that you wish to cancel, you normally have a further 14 days to return the goods.

Returned items should be unused and in their original condition, allowing for reasonable handling to inspect the goods as you would in a shop.

Unless the item is faulty, damaged or not as described, you will be responsible for the cost of returning an unwanted item.

Where you exercise your legal right to cancel, I will provide a refund in accordance with applicable UK consumer law. This will normally include the cost of the standard delivery option you originally paid for, but not any additional cost resulting from choosing a more expensive delivery option.

I may wait to issue the refund until I have received the returned goods or you have provided evidence that they have been sent back.

return and postage costs are your responsibility and I will not be responible for the product until it has been safely recieved.

Custom and personalised products

Where a product has been made specifically for you, personalised at your request or made to your individual specifications, the normal 14-day change-of-mind cancellation right may not apply.

However, custom or personalised products still have legal protections if they are faulty, damaged, not as described or otherwise do not meet the requirements of UK consumer law.

If you are unsure whether your item qualifies as personalised or custom-made, please contact me before placing your order.

9. Faulty, Damaged or Incorrect Items

Your statutory consumer rights are not affected by these Terms.

If your item is faulty, damaged, not as described or does not meet the requirements of the Consumer Rights Act 2015, please contact me.

Depending on the circumstances, you may be entitled to a repair, replacement, price reduction or refund in accordance with UK consumer law.

Please contact me at:

donnaswoodworks@outlook.com

I may ask for photographs or other information to help me understand the problem.

10. Refunds

Where a refund is due, I will process it using the original payment method where reasonably possible.

Refunds will be made in accordance with the applicable consumer protection legislation.

For a standard online cancellation, I will normally issue the refund within 14 days of receiving the returned goods or, where applicable, receiving evidence that they have been sent back.

This does not affect any different rights that may apply where goods are faulty, damaged or not as described.

11. Intellectual Property

All photographs, product designs, written descriptions, logos, branding and other content on my website belong to Donna's Woodworks or are used with permission.

You may view and use my website for your own personal, non-commercial purposes.

12. Reviews and Feedback

If you choose to leave a review, photograph, comment or other feedback about Donna's Woodworks, you confirm that the content is your own and does not infringe another person's rights.

I may display genuine customer reviews and feedback on my website or social media to help other customers understand my products.

I will not knowingly alter a genuine customer review in a way that changes its meaning.

I reserve the right to remove or decline to publish content that is unlawful, abusive, threatening, defamatory, discriminatory, misleading or otherwise inappropriate.

13. Third-Party Services and Links

My website may use third-party services, including Shopify, payment providers and delivery services.

These services may have their own terms and privacy policies.

I am not responsible for the content or operation of third-party websites that may be linked to from my website.

14. Shopify

My online store is powered by Shopify.

Shopify provides the technology that allows me to operate my online store, process and manage orders and provide certain website functionality.

However, when you purchase a product from Donna's Woodworks, the sale is between you and Donna's Woodworks.

Nothing in these Terms removes or limits any rights you have against me under UK consumer law.

15. Privacy

I collect and use personal information in accordance with my Privacy Policy.

Information provided when placing an order may be processed by Shopify and other service providers where necessary to process your payment, fulfil and deliver your order and provide my services.

Please see my Privacy Policy for more information about how I collect, use and protect personal information.

16. Website Information and Errors

I make reasonable efforts to ensure that the information on my website is accurate.

Occasionally, there may be errors relating to product descriptions, prices, availability or delivery information.

If I discover an obvious error before an order has been accepted, I may contact you to correct the error or cancel the order and provide a full refund where appropriate.

I will not use an obvious error to unfairly deprive you of your legal rights.

17. Limitation of Liability

Nothing in these Terms excludes or limits my liability where it would be unlawful to do so.

This includes liability for death or personal injury caused by my negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be excluded or limited.

Nothing in these Terms affects your statutory consumer rights, including your rights in relation to faulty, unsafe or misdescribed goods.

Subject to the above, I will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside my reasonable control.

18. Events Outside My Control

I will not be responsible for a failure or delay in fulfilling my obligations where this is caused by circumstances outside my reasonable control.

This may include events such as severe weather, natural disasters, strikes, transport disruption, major postal disruption, power or internet failures, or other circumstances that I could not reasonably have prevented.

I will make reasonable efforts to minimise any disruption and fulfil your order as soon as reasonably possible.

19. Changes to These Terms

I may update these Terms from time to time to reflect changes to my business, products or legal requirements.

The version that applies to your order will generally be the version available when you place your order.

Any changes will not affect rights that you have already acquired under an existing order.

20. Governing Law

These Terms are governed by the law of England and Wales.

If you are a consumer, you will also retain any mandatory rights and protections provided to you under the laws that apply to you.
